NASHVILLE(AP) — A Tennessee legislative leader is asking the attorney general for guidance on whether the House of Representatives can expel a member for conduct that occurred decades ago.

Rep. Cameron Sexton, who has been appointed by his Republican caucus to become the next House speaker, submitted the request Wednesday.

Lawmakers will meet on Friday for a special legislative session to formally elect Sexton to the leadership position. However, advocates hope lawmakers also use the time to expel Republican Rep. David Byrd, who is accused of sexual misconduct by three women nearly 30 years ago.

Sexton specifically requested information on whether a member can be ousted when voters were aware of the allegations before the latest election.

It is unknown if Attorney General Herbert Slatery's opinion will be finished before Friday's session.
