HENDERSONVILLE (AP) — Prosecutors have dropped a case against a Hendersonville police officer who was arrested and charged with driving under the influence.

District Attorney's Office spokesman Steve Hayslip tells The Tennessean that the charge against Officer Derick Brewer was dropped because he met certain conditions including that he attend Alcohol Safety School.

Police Chief Mickey Miller says Brewer was suspended without pay on Jan. 18 following an internal investigation into the June offense. The chief says Miller will return to patrol on Feb. 8.

Hayslip says Brewer was a first time offender with a blood alcohol level just over the legal limit who faced termination if convicted. He says DUI cases of that nature are often handled this way.

Brewer's attorney Thomas Overton didn't immediately respond to the newspaper's request for comment.
