Pursuant to The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108 and Tennessee Rules, Chapter 0400-40-07, the proposed activity described below has been submitted for approval under an Aquatic Resource Alteration Permit and Section 401 Water Quality Certification. PROJECT DESCRIPTION / PURPOSE

Pleasant Creek Investments, Inc. proposes unavoidable permanent impacts to 388.5 linear feet of stream and 0.07 acres of wetland, and temporary impacts to six feet of stream associated with the construction of the Pleasant Creek subdivision and its associated infrastructure in Thompson’s Station. In-system mitigation for permanent stream and wetland impacts will be provided through credit purchases from the Harpeth River Mitigation Bank.

ANTIDEGRADATION

In accordance with the Tennessee Antidegradation Statement (Rule 0400-40-03-.06), the Division has made a preliminary determination that the proposed activities will result in de minimis degradation of waters with available parameters because the applicant proposes to provide in-system mitigation to offset any appreciable permanent loss of resource values.

FACTORS CONSIDERED

In deciding whether to issue or deny this permit, the Division will consider all comments of record and the requirements of applicable federal and state laws. The Division will consider the nature, scale and effects of proposed impacts. The Division will consider practicable alternatives to the alteration, loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impacts to unique, high quality, or impaired waters. In making this decision, a final determination will be made evaluating appreciable permanent loss of resource values and proposed compensatory mitigation to ensure the project will result in no overall net loss of state water resources values.

HOW TO COMMENT

TDEC is requesting public comment on this proposed permit action. Obtaining a broad range of facts and opinions on Agency actions is one of the best ways to ensure appropriate decisions. Persons wishing to comment on the proposal are invited to submit written comments to the Division. Written comments must be received within thirty days following distribution of the approved public notice materials (including signage and newspaper ad). Comments will become part of the record and will be considered in the final decision. The applicant’s name and permit number should be referenced. NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that on August 26, 2024, a public hearing, as required by Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), will be held by the National Finance Authority (the “Authority”), a component unit of the Business Finance Authority of the State of New Hampshire, with respect to the proposed issuance by the Authority of its tax-exempt Education Revenue Bond (Harding Academy Project), Series 2024, in one or more issues (the “Bonds”), in a principal amount not to exceed $9,600,000. The hearing will commence at 4:00 p.m. Central, or as soon thereafter as the matter can be heard, and pursuant to Internal Revenue Service Revenue Procedure 2022-20, the hearing will be held via toll free telephonic means accessible to the general public as described below.

The Bonds are expected to be issued pursuant to Chapter 162-A of the New Hampshire Statutes, and the proceeds from the sale of the Bonds will be loaned to Harding Academy (the “Borrower”), a Tennessee nonprofit corporation and an organization described in section 501(c)(3) of the Code that is exempt from tax under section 501(a) of the Code. The Bonds are expected to be qualified 501(c)(3) bonds, as defined in section 145 of the Code, and the proceeds of the Bonds will be applied along with other available funds, for the following purposes: (a) to finance the acquisition, construction, renovation and equipping of various educational, administrative, athletic and other facilities for the Borrower (the “Project”) on its campus located at 170 Windsor Drive, Nashville, Tennessee 37205, including, but not limited to, a new Early Childhood Center for Pre-K and Kindergarten students and (b) to finance costs of issuance of the Bonds. The Project will be owned and operated by the Borrower.

The Bonds will be special, limited obligations of the Authority payable solely from the loan repayments to be made by the Borrower to the Authority, and certain funds and accounts established under the bond documents for the Bonds.
