SHERIFF’S NOTICE OF SALE

WHEREAS on June 7, 2011, Geoffrey Mason (hereinafter referred to as “Creditor”) obtained a judgment in the General Sessions Court for Davidson County, Tennessee against Corey Lamar Allen (hereinafter referred to as “Debtor ”) for Thirty Thousand Dollars ($30,000) plus costs of One Hundred, Ninety Two Dollars and Seventy-Five cents ($192.75) plus interest. Geoffrey Mason v. Corey Lamar Allen, Case # 11GC6875, General Sessions Court for Davidson County, Tennessee.

WHEREAS on August 31, 2011 the Creditor filed a “Notice of Judgment Lien” against the real property of the Debtor at 705 Moormans Arm Road, Nashville, 37207, Davidson County, Tennessee. (hereinafter referred as the “Property”) Document # 20110831-0067348 in the Register of Deeds for Davidson County, Tennessee. A legal description of the Property is described below.

WHEREAS on April 15, 2021 an “Abstract of Lien Pendens” was filed on the Property. Document # 2021-0415-0050227 in the Register of Deeds for Davidson County, Tennessee.

WHEREAS on April 20, 2021 the Plaintiff filed a Motion for Extension of the Judgment in the matter of Geoffrey Mason v. Corey Lamar Allen, General Sessions Court. On May 28, 2021 an order was entered which granted the extension until June 11, 2031.

WHEREAS on or about September 30, 2021 a Rule 60.02 motion was filed to correct the Order of Extension from June 11, 2031 to June 7, 2031. The motion was granted and an Order was entered on October 14, 2021 which corrected the motion for extension from June 11, 2031 to June 7, 2031.

WHEREAS on June 16, 2022, the Creditor filed a complaint in the Chancery Court for Davidson County, Tennessee seeking the enforcement of the judgment by the issuance of a Writ of Attachment on the Property to be sold and the amount owed by the Debtor to the Creditor on the judgment be satisfied out of the proceeds of that sale. Geoffrey Mason v, Corey Lamar Allen, Case # 22-0844-II, Chancery Court for Davidson County, Tennessee.

WHEREAS unable to obtain personal service upon the Debtor in the Chancery Court matter, the Creditor filed a motion to obtain service of process by publication. This motion was granted and two (2) orders were entered: (1) an “Order Allowing Service of Process by Publication”; (2) and an “Order of Publication”. A copy of the latter was published for four (4) consecutive weeks in “The Tennessean” with publication made on June 23, 2023; June 30, 2023; July 7, 2023; and July 14, 2023.

WHEREAS when the Debtor failed to timely file an answer to complaint, the Creditor filed a motion for default judgment.

WHEREAS on March 13, 2024 the Creditor was granted judgment against the Debtor wherein the Chancery Court, pursuant to T.R.C.P 69.07(4), directed the Sheriff for Davidson County to sale the Property to be sold and proceeds of the sale applied first to the sheriff’s statutory fees and reasonable expenses, then to court costs, then to the Creditor, and then any remaining balance to the Debtor.

WHEREAS there is $67,273.69 owed on the judgment from June 7, 2011 through June 7, 2024; however this amount will increase with the passage of time pursuant to the Tennessee Judgment Interest Rate and the Debtor’s failure to satisfy the judgment.

NOW, THEREFORE by virtue of the authority vested in the Davidson County Sheriff and pursuant to T.R.C.P. 69.07 and pursuant to the order of the Chancery Court in the matter of Geoffrey Mason v, Corey Lamar Allen, Case # 22-0844-II, Chancery Court for Davidson County, Tennessee which directed the Sheriff of Davidson County, Tennessee to sale the Property.
